Protection attorney to evaluate enchantment in Stewart case

Research is coming next as an appeal on child sex charges moves forward.

Joe Louis Stewart was convicted in 2018 on two counts of aggravated indecent liberties against a girl who was allegedly nine years old during an incident in 2016. Stewart was sentenced to 25 years in prison with no chance of parole, and he has been appealing since.

During a hearing Wednesday in Lyon County District Court, defense attorney Paul Dean — who was not part of the original proceedings — was granted 60 days to review Stewart’s allegations of ineffective legal counsel, improper jury instructions and prosecutorial misconduct and to file an amended petition if he chooses. Prosecutor Laura Miser says the County Attorney’s Office plans to file a motion to dismiss, and she will have 30 days to do so once Dean decides how he will proceed.

The next hearing is April 22.
